Last Updated: June 22, 2026
Please read these Terms of Use carefully before using the Unlimited Outdoors website (“Site”). By accessing or using this Site, you agree to be bound by these terms. If you do not agree, please do not use this Site.
1. Acceptance of Terms
These Terms of Use govern your access to and use of the Site and any information, services, or features provided through it. We may update these terms at any time, and continued use of the Site after changes means you accept the updated terms.
2. Use of the Site
You may use this Site for lawful purposes only. You agree not to interfere with the operation of the Site, attempt to gain unauthorized access, or use the Site to transmit harmful or illegal content. We reserve the right to restrict or terminate access to the Site for any violation of these terms.
3. Our Services
Unlimited Outdoors provides hardscape, landscape, drainage, excavation, and related outdoor construction services in Northwest Arkansas. Information on this Site is for general informational purposes and does not constitute a binding offer, contract, or guarantee of services.
4. Estimates and Quotes
Any estimate, quote, or pricing information provided through this Site, by phone, or during an initial consultation is preliminary and subject to an on-site evaluation. Final pricing is determined by project scope, site conditions, materials, labor, accessibility, and other factors. A written quote or contract must be signed by both parties before work begins.
We reserve the right to adjust pricing if project conditions change, including unforeseen site conditions, material availability, or requested modifications. We will communicate any changes before proceeding.
5. Payments, Deposits, and Cancellation
Payment terms are set out in each project contract or written quote. Deposits may be required to secure materials and schedule work. Cancellations, rescheduling, and refund terms are governed by the signed contract and applicable law.
6. Warranties and Guarantees
We stand behind our work and perform a final walkthrough with every customer before considering a job complete. Specific warranty terms for materials and workmanship are detailed in the written contract for each project. Manufacturer warranties on materials are passed through to the customer as provided by the manufacturer.
Our satisfaction guarantee applies to work performed by Unlimited Outdoors in accordance with the contract and does not cover damage caused by weather, improper maintenance, third-party alterations, or normal wear and tear.
7. Limitation of Liability
To the fullest extent permitted by law, Unlimited Outdoors and its owner, employees, and agents are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this Site or our services, even if advised of the possibility of such damages. Our total liability for any claim arising from services performed is limited to the amount paid by the customer for those specific services.
This Site is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Indemnification
You agree to indemnify and hold harmless Unlimited Outdoors, its owner, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these terms, or your negligence or misconduct.
9. Intellectual Property
All content on this Site, including text, images, logos, graphics, and design, is the property of Unlimited Outdoors or its licensors and is protected by copyright, trademark, and other intellectual property laws. These Terms of Use are governed by the laws of the State of Arkansas, without regard to conflict of law principles. Any dispute arising from these terms or our services will be resolved in the state or federal courts located in Benton County, Arkansas. Both parties agree to submit to the exclusive jurisdiction of those courts.
11. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
